प्रश्न 1. इस वर्ष असाधारण रूप से भीषण गर्मी होने के कारण, जिले को पानी की घोर कमी का सामना करना पड़ रहा है। जिला कलेक्टर जिले को गंभीर पेयजल संकट से उबारने हेतु शेष जल भंडार को संरक्षित करने के लिए अपने अधीनस्थ अधिकारियों को सक्रिय कर रहे हैं। जल संरक्षण के लिए जागरूकता अभियान के साथ-साथ भू-जल के अत्यधिक दोहन को रोकने के लिए सख्त कदम उठाए गए हैं। गाँवों का दौरा करने हेतु सतर्कता दल तैनात किए गए हैं। सिंचाई के लिए गहरे बोरवेल अथवा नदी जलाशय से पानी खींचने वाले किसानों की शिनाख्त की जा रही है। ऐसी कार्रवाई से किसान आक्रोश में आ जाते हैं। किसानों का एक प्रतिनिधिमंडल अपने मुद्दों को लेकर जिला कलेक्टर से मिलता है और शिकायत करता है कि जहाँ उन्हें अपनी फसल की सिंचाई की अनुमति नहीं दी जा रही है, वहीं नदी के पास स्थित बड़े उद्योग अपनी औद्योगिक प्रक्रियाओं के लिए गहरे बोरवेल के माध्यम से भारी मात्रा में पानी खींच रहे हैं। किसानों का आरोप है कि उनका प्रशासन किसान विरोधी और भ्रष्ट है, जिसे उद्योग द्वारा रिश्वत दी जा रही है। जिलों को, किसानों को शांत करने की ज़रूरत है क्योंकि वे लंबे समय तक विरोध प्रदर्शन करने की धमकी दे रहे हैं। वहीं जिला कलेक्टर को जल संकट से निपटना भी होगा। उद्योग को बंद नहीं किया जा सकता क्योंकि इससे बड़ी संख्या में श्रमिक बेरोजगार हो जाएँगे।

(a) एक जिला मजिस्ट्रेट के रूप में जिला कलेक्टर के लिए उपलब्ध सभी विकल्पों पर चर्चा कीजिए।

(b) हितधारकों के परस्पर अनुकूल हितों को ध्यान में रखते हुए कौन-सी उचित कार्रवाइयाँ की जा सकती हैं?

(c) जिला कलेक्टर के लिए संभावित प्रशासनिक और नैतिक दुविधाएँ क्या हैं?

With the summer heat being exceptionally severe this year, the district has been facing severe water shortage. The District Collector has been mobilizing his subordinate officials to conserve the remaining water reserves for preventing the district from plunging into acute drinking water crisis. Along with an awareness campaign, for conserving water, (strict measures have been taken for stopping the over-exploitation of ground-water. Vigilance teams have been deployed to tour the villages and find the farmers who are drawing water from deep borewells or from the river reservoir for irrigation. The farmers are agitated by such action. A delegation of farmers meets the District Collector with their issues and complains that while they are not being allowed to irrigate their crops, big industries located near the river are drawing huge amounts of water through deep borewells for their industrial processes. The farmers allege that their administration is anti-farmer and corrupt, being bribed by the industry. The district needs to placate the farmers as they are threatening to go on a prolonged protest At the same time, the District Collector has to deal with the water crisis. The industry cannot be closed as this would result in a large number of workers being unemployed.

(a) Discuss all options available to the District Collector as a District Magistrate.

(b) What suitable actions can be taken in view of mutually compatible interests of the stakeholders?

(c) What are the potential administrative and ethical dilemmas for the District Collector? [20 Marks, 250 Words]

प्रश्न 2. डॉ. श्रीनिवासन एक प्रतिष्ठित जैव-प्रौद्योगिकी कंपनी में कार्यरत एक वरिष्ठ वैज्ञानिक हैं। यह कंपनी फार्मास्युटिकल में अपने अत्याधुनिक शोध के लिए जानी जाती है। डॉ. श्रीनिवासन किसी नई दवा पर काम करने वाली एक शोध टीम का नेतृत्व कर रहे हैं, जिसका उद्देश्य एक नए वाइरस (विषाणु) से तेजी से फैलने वाले संक्रमित रोग का इलाज करना है। यह बीमारी दुनिया भर में तेजी से फैल रही है और देश में इसके मामलों की संख्या धीरे-धीरे बढ़ रही है। डॉ. श्रीनिवासन की टीम पर इस दवा के ट्रायल में तेजी लाने का बहुत दबाव है क्योंकि इसके लिए बाज़ार में काफी माँग है और कंपनी बाज़ार में पहला कदम रखने का फायदा उठाना चाहती है। टीम मीटिंग के दौरान, टीम के कुछ वरिष्ठ सदस्यों ने दवा के क्लिनिकल (नैदानिक) परीक्षणों में तेजी लाने और अपेक्षित अनुमोदन प्राप्त करने के लिए कुछ शॉर्टकट सुझाए। इनमें कुछ नकारात्मक परिणामों को बाहर करने के लिए डेटा में हेरफेर करना और चुनिंदा रूप में सकारात्मक परिणामों की रिपोर्ट करना, सूचित सहमति की प्रक्रिया को छोड़ देना और स्वयं का घटक विकसित करने के बजाए, प्रतिद्वंद्वी कंपनी द्वारा पहले से पेटेंट किए गए यौगिकों का उपयोग करना शामिल हैं। डॉ. श्रीनिवासन ऐसे शॉर्टकट लेने में सहज नहीं हैं, साथ ही उन्हें यह भी पता चला है कि इन तरीकों का उपयोग किए बिना लक्ष्यों को पूरा करना असंभव है।

(a) ऐसी स्थिति में आप क्या करेंगे?

(b) इसमें शामिल नैतिक प्रश्नों के प्रकाश में अपने विकल्पों और परिणामों का परीक्षण कीजिए।

(c) ऐसे परिदृश्य में, डेटा नैतिकता और औषधि नैतिकता किस प्रकार बड़े पैमाने पर मानवता को बचा सकती हैं?

Dr. Srinivasan is a senior scientist working for a reputed biotechnology company known for its cutting-edge research in pharmaceuticals. Dr. Srinivasan is heading a research team working on a new drug aimed at treating a rapidly spreading variant of a new viral infectious disease. The disease has been rapidly spreading across the world and the cases reported in the country are increasing. There is huge pressure on Dr. Srinivasan’s team to expedite the trials for the drug as there is significant market for it, and the company wants to get the first-mover advantage in the market. During a team meeting, some senior team members suggest some shortcut for expediting the clinical trials for the drug and for getting the requisite approvals. These include manipulating data to exclude some negative outcomes and selectively reporting positive results, foregoing the process of informed consent and using compounds already patented by a rival company, rather than developing one’s own component. Dr. Srinivasan is not comfortable taking such shortcuts, at the same time he realises meeting the targets is impossible without using these means.

(a) What would you do in such a situation?

(b) Examine your options and consequences in the light of the ethical questions involved.

(c) How can data ethics and drug ethics save humanity at large in such a scenario? [20 Marks, 250 Words]
