Introduction

Merits of the Labour Codes in India

(i) Consolidation of Laws: By merging 29 laws into four “Labour Codes,” compliance becomes simpler for businesses, making it easier for them to understand and adhere to regulations, reducing bureaucratic complexities. 

(ii) Flexibility in Employment Terms: The Industrial Relations Code allows for “fixed-term contracts,” enabling employers to adjust workforce levels based on market demand while ensuring that workers receive similar benefits as permanent employees. 

(iii) Inclusion of Gig Workers: The Social Security Code extends benefits to gig and platform workers, recognizing their contributions and providing them with access to essential protections such as health insurance and retirement benefits. 

(iv) Streamlined Dispute Resolution: Introducing “time-bound dispute resolution mechanisms” fosters quicker resolution of labour disputes, thereby enhancing workplace harmony and encouraging better employer-employee relations, which can boost productivity. 

(v) Enhanced Compliance through Technology: The codes promote the use of technology for compliance and monitoring, leading to improved record-keeping and transparency, thus reducing corruption and enhancing trust in the system. 

Demerits of the Labour Codes in India

(i) Limited Union Empowerment: Stricter conditions for union formation may weaken workers’ “collective bargaining” power, potentially undermining their ability to negotiate better wages and working conditions, thereby diminishing workers’ influence. 

(ii) Job Insecurity Risks: The flexibility in hiring and firing could lead to “job insecurity,” particularly in sectors that may misuse these provisions, negatively affecting workers’ confidence in long-term employment stability. 

(iii) Unclear Provisions for Gig Workers: Although gig workers are included, the absence of detailed “welfare provisions” leaves gaps in their protections, making it challenging to ensure their rights and benefits are adequately addressed. 

(iv) Exclusions for Small Enterprises: The codes may inadvertently leave smaller enterprises outside certain regulations, limiting “social security coverage” for a significant portion of the workforce, particularly in the informal sector. 

(v) Implementation Delays: States face challenges in adapting their legal frameworks to the new codes, causing delays in effective implementation and creating inconsistencies across the country that can hinder progress. 

Progress in Implementation of Labour Codes

(ii) State Adoption Delays: Despite the central government’s efforts, several states have yet to finalize their regulations under the codes, resulting in varied implementation timelines and inconsistency in worker protections across regions. 

(iii) Consultations with Stakeholders: The government has engaged in discussions with industry and labour unions to address concerns, demonstrating a willingness to adapt the codes based on feedback from various stakeholders. 

(iv) Promotion of Digital Compliance: Initiatives to digitize compliance and registration processes are being implemented, allowing for greater accessibility and transparency in the labour market, facilitating easier adherence to regulations. 

(v) Pilot Programs for Gig Workers: Trials for social security initiatives targeting gig workers are being launched, providing insights into effective implementation and helping to shape future policies to support this growing workforce segment.
