Affirmative action in India is designed to provide equal opportunities and uplift marginalized communities, yet its implementation often falls short.

(i) Constitutional Provisions: The Indian Constitution’s “Articles 15” and “17” promote equality and prohibit discrimination, providing a legal framework for affirmative action aimed at “Scheduled Castes” (SCs), “Scheduled Tribes” (STs), and “Other Backward Classes” (OBCs).

(ii) Reservation Policies: Affirmative action manifests through “reservations” in educational institutions and public employment. However, the effectiveness of these policies varies significantly across states and sectors.

(iii) Welfare Schemes: Various schemes like “Mid-Day Meal” and “National Rural Employment Guarantee Act” aim to support underprivileged sections. Yet, inadequate funding and implementation flaws often undermine their potential.

(iv) Judicial Support: The judiciary has played a role in upholding affirmative action. However, frequent legal challenges have also led to restrictions on reservation policies, complicating their effectiveness.

(iv) Urban-Rural Disparity: Marginalized communities in rural areas often face greater challenges in accessing affirmative action benefits due to geographical isolation and lack of infrastructure.

(v) Gender Disparities: Women from underprivileged sections face additional barriers due to gender discrimination, limiting their access to education and employment opportunities, thus undermining the goals of affirmative action.

The Need for Comprehensive Reforms

To bridge the gap between policy and actual benefits, comprehensive reforms are necessary.

(i) Strengthening Implementation Mechanisms: Creating robust monitoring and evaluation frameworks can ensure effective implementation of policies and facilitate accountability within implementing agencies.

(iii) Enhancing Educational Opportunities: Investment in quality education and vocational training can empower underprivileged groups to leverage affirmative action benefits effectively and achieve socio-economic mobility.

Despite existing policies, underprivileged groups face significant barriers to accessing affirmative action benefits. Comprehensive reforms and effective implementation are essential to fulfill the promise of “equity” and “social justice.”
